Evercrest Technologies Inc. filed a civil claim against LayerZero Labs Ltd. in British Columbia on Sept. 24, according to a court listing.

Kelp’s terms of service identify Evercrest as the company providing its app. The court report lists the case at Vancouver Law Courts under file number 267169.

LayerZero Labs CEO Bryan Pellegrino said the notice of civil claim also names him.

“The claim continues to be meritless, will meet them in Vancouver and defend myself accordingly,” Pellegrino wrote.

The Defiant has not obtained the notice of civil claim and could not independently verify its allegations or the relief sought. Pellegrino’s statement did not describe the legal basis of the action.

Earlier Clash Over rsETH Security

KelpDAO and LayerZero had already been publicly disputing responsibility for the April 18 rsETH bridge exploit. The bridge moved KelpDAO’s liquid restaking token, rsETH, between blockchains.

Chainalysis estimated that attackers stole 116,500 rsETH, worth roughly $292 million at the time. According to its analysis, attackers fed false blockchain data to infrastructure used by the LayerZero Labs verifier, prompting the Ethereum bridge contract to release tokens without a corresponding token burn on the source chain.

In an April 19 statement, LayerZero blamed KelpDAO’s reliance on a single decentralized verifier network, or DVN, which checks cross-chain messages. LayerZero said it had recommended using multiple independent verifiers.

KelpDAO countered on April 20 that the single-verifier setup was LayerZero’s documented default and that the configuration had been confirmed as appropriate during Kelp’s Layer 2 expansion.

LayerZero later acknowledged in a May 8 update that it had “made a mistake by allowing our DVN to act as a 1/1 DVN for high-value transactions.” It said its verifier no longer served single-verifier configurations.

rsETH bridging through LayerZero continued this month. On Sept. 12, Kelp said rsETH bridging via LayerZero was “fully restored,” following a planned 24-hour pause for settlement operations.
